BECOMING BOUNDARIED: THE GRADUATE CIRCLE PARTICIPATION AGREEMENT
By signing where indicated below, you irrevocably agree that if Boundaried Coaching LLC® (the “Company” or “we/us”) approves your application and accepts you as a Becoming Boundaried: The Graduate Circle™ (the “Program”) participant, this agreement automatically becomes a binding contract you and the Company, and applies to your participation in the Program. By signing below, you are acknowledging that you have read, agree to and accept all of the terms and conditions contained in this Agreement. We reserve the right to amend this Agreement at any time by sending you a revised version at the address you provided.
The investment to take part in the Becoming Boundaried: The Graduate Circle Live Coaching Membership Program is the following: a monthly fee of $99 to be billed monthly until the client requests to cease membership (which must be done in writing, such as through email, with at least 2 business days notice before the next billing cycle) at which point the monthly membership will end on the last day of the last paid month.
By completing the agreement and signing below, you authorize Boundaried Coaching LLC to charge your credit card $99 on a monthly basis as payment for your membership in the Program. You also understand that there is no money-back guarantee offer once a month has been paid for.
We are committed to providing all Becoming Boundaried: The Graduate Circle participants with a positive Program experience. By signing below, you agree that the Company may, at its sole discretion, terminate this agreement, and limit, suspend or terminate your participation in the Program without refund or forgiveness of remaining monthly payments if you become disruptive or difficult to work with or if you impair the participation of the Program instructor or participants in the Program.
As a Participant of this Program, and by signing below, you acknowledge that you are paying for and will have access to the following:
(A) Access to a minimum of 2 (90-minute) live coaching calls per month with Molly for the duration of your membership.
(B) Continued access to the Beautiful Boundaries Bootcamp Online Portal.
(C) Access to the Elephant Beloved Online Portal, which includes additional training videos created for Elephant Beloved members.
(D) Access to additional program coaching calls and peer-led call options when available. Please note that calls provided on a volunteer basis exist to support ongoing peer connections and encouragement. You are aware that peer-led calls are volunteer-led and peer-based in nature. While the company desires to facilitate opportunities for positive peer interactions, Boundaried Coaching LLC cannot be held liable for the content of any calls hosted on a peer/volunteer basis.
(E) Full complimentary inclusion in our private Becoming Boundaried: The Graduate Circle community group (for 24/7 peer-led discussion, encouragement, and peer-support).
We respect your privacy and must insist that you respect the privacy of other Program participants. By signing below, you (1) agree not to violate the publicity or privacy rights of any Program participants. You understand that you may not record group coaching calls. You also understand that some portions of the group coaching calls may be recorded by the call host [teaching portions only, which will not reveal any names, faces, or details of the call participants]. We respect your confidential and proprietary information, ideas, plans and trade secrets (collectively “Confidential Information”) and must insist that you respect the same rights of fellow Program participants and of the Company. While we work hard to protect the privacy of all program participants, and while each participant signs this form indicating that they will respect other program participants' confidentiality as a condition of their participation, your signature here indicates that (2) you understand the limits of confidentiality in a small group and online setting, in that it cannot be fully guaranteed as per the nature of small group and online platform limitations.
By signing below, you agree (3) to not infringe upon any Program participants or the Company’s copyright, patent, trademark, trade secret, or any other intellectual property rights, (4) that in any Confidential Information shared by Program participants or any representative of the Company is confidential and Proprietary, and belongs solely and exclusively to the Participant who discloses it or the Company, (5) you agree not to disclose such information to any other person or use it any manner other than in discussion with other Program participants during program sessions.
By signing below, you indicate (6) that you fully understand that the Becoming Boundaried: The Graduate Circle program will not provide you with counseling services and is 100% a coaching-based program. This means it is primarily educational in scope, which includes motivation and encouragement from your coach-educator. Any program coaches, even if also employed elsewhere as mental health professionals, will NOT be working for you as mental health professionals but rather as coaches only. Boundaries-focused coaching differs from counseling as it does not provide a mental health diagnosis or mental health treatment. Boundaries coaching and teaching in a small group format provides generalized boundaries principles and advice that may not always fit your exact situation. By signing below, you (7) acknowledge that you understand this and that you have NO expectation of receiving mental health counseling or individualized treatment from Boundaried Coaching LLC or the Elephant Beloved Program. Additionally, you understand that any peer-led calls (led by volunteers) are peer-support based, intended for encouragement, and therefore should not be considered instructional in nature, nor should any statements or opinions made by volunteers be seen as representative of the Company.
The focus of Boundaried Coaching and its program niches are specifically to help adults develop healthy boundaries, which includes a wide variety of subject matter. By signing (8), you indicate that you understand some of the subject matter may be triggering or emotionally difficult at times. Your signature indicates that (9) you have adequate coping skills for safely navigating any difficult or strong emotions that may arise, as well as adequate local resources should you need additional help managing any feelings that may come up.
By signing, you (10) also indicate that you understand that in the unlikely event that you experience any significant mental health challenges during your involvement with this program (such as suicidality, severe depression, manic episode, panic attack, or etc.), we are unable to help you navigate such within the scope and boundaries of the coaching relationship. This means that you will be referred to services in your area for appropriate care in order to ensure your safety. In the unlikely event of a mental health emergency, you (11) agree to provide your preferred emergency contact information below. You also understand that your coach(es) are mandated reporters, therefore any threat of harm to self or others must be reported to the appropriate authorities.
By signing below, you further agree that (with the exception of information clearly attributed to other sources) (12) all materials and information provided to you by Boundaried Coaching LLC are its confidential and proprietary intellectual property belonging solely and exclusively to the Company, and may only be used by you as authorized by the Company, and the reproduction, distribution and sale of these materials by anyone but the Company is strictly prohibited. Further, by signing below, you agree that (13), if you violate, or display any likelihood of violating any of your agreements contained in this paragraph the Company and/or the other Program participants will be entitled to injunctive relief to prohibit any such violations to protect against the harm of such violations. The laws applicable to this Agreement will be the laws of Alaska, USA, and the parties agree to “attorn” to the exclusive jurisdiction of Alaska Courts to finally adjudicate and determine any such dispute both before and after termination of this Agreement.
We have made every effort to accurately represent the program and its potential. Each individual’s success depends on many factors, including willingness to do the work, get the necessary support, and a desire to succeed. By signing below, you acknowledge (14) that you assume 100% responsibility for your results. By signing below, you also acknowledge that (15) you have represented to the Company that payment of your Program membership fees will not place a significant financial burden on you or your family.
